Can I place a garden studio in my garden ? What rules apply ?

Dans bien des cas, les gens rêvent d’un abri de jardin mais ne connaissent pas clairement les réglementations urbanistiques à respecter. Il y a effectivement quelques obligations qui relèvent de compétences régionales.


Dans tous les cas, nous recommandons d’appeler votre commune avant de vous lancer dans un projet d’annexe de jardin car les réglementations urbanistiques communales peuvent être plus restrictives que le règlement régional (surtout les communes urbaines ou ayant un patrimoine protégé).

L’abris doit toujours se situer dans une zone de cours et jardins, à l’arrière de la maison, non visible depuis la rue.

Voici un aperçu des réglementations en vigueur dans les trois régions belges : la Flandre, la Wallonie et la Région de Bruxelles-Capitale. 

Faites de votre rêve une réalité en Flandre

Si vous habitez en Flandre, nous avons d’excellentes nouvelles pour vous ! L’installation d’un studio de jardin Woodcab ne nécessite pas de permis de construire si la structure ne dépasse pas 40 mètres carrés et si elle est installée à une distance minimale de 3 mètres des limites latérales de la parcelle. Les règlementations flamande précisent que vous avez le droit d’avoir plusieurs annexes de jardin (abris et serres compris) à condition que la somme de leurs surfaces ne dépasse pas 40m2. Dans certaines communes, on vous demandera d’effectuer une notification en ligne précisant la nature de votre demande pour laquelle vous recevrez un avis dans les 30 jours.

Profitez de l’espace supplémentaire en Wallonie

En Wallonie, le CODT (Code de développement territorial) a été assoupli ces dernières années. Vous n’aurez pas besoin de permis de construire pour un studio de jardin de moins de 20 mètres carrés, à condition qu’il soit installé à au moins 1 mètre de toutes les limites mitoyennes et que la hauteur de la corniche soit inférieure à 2,5m. Un autre pas vers votre oasis de paix.

Votre refuge urbain dans la Région de Bruxelles-Capitale

Même dans la Région de Bruxelles-Capitale, pour un studio de jardin de moins de 9 mètres carrés, aucun permis de construire n’est nécessaire. La réglementation exige que vous respectiez une certaine distance par rapport à la limite de votre propriété. Cette distance peut être réduite avec le consentement de votre voisin ou sous certaines conditions. De cette façon, votre espace tranquille ne perturbe pas l’harmonie de votre quartier.
